National Information Sharing Consortium Terms of Use

 

These Terms of Use govern the relationship between the National Information Sharing Consortium, hereafter referred to as the “NISC” and any State, Local, Tribal, Federal, International, Non-governmental, Academic or Private industry organization that may choose to apply for membership in the NISC, and who are hereafter referred to as “Members.”*:

TERMS OF AGREEMENT

  1. The Members agree to share information with other members of the organization, at will, and as permitted by the laws or regulations of their organization, best practices and program artifacts, and technology to increase the effectiveness and realize efficiencies to help advance each of their information access and sharing initiatives.
  2. The Members have the full discretion to decide what information, best practices and technology they are willing or able to share with the other Members of the NISC.
  3. In addition to realizing efficiencies in time and resources, the Members anticipate that by carrying out the activities in these Terms of Use they will also significantly advance the ability of their organization/jurisdiction/agency to improve their information sharing capabilities.
  4. The Members of the NISC recognize the importance of the activities discussed within these Terms of Use for advancing information sharing nationwide and across the globe. Towards this end the Members of the NISC anticipate seeking out other Members to participate in the activities outlined in the Terms of Use.

GOVERNANCE

  1. The points of contact to carry out these terms of Use will be provided by the signatory to these Terms.
  2. These Terms of Use will be governed by the representatives from each of the Members through the establishment of a NISC Board of Directors as outlined within the NISC By-Laws.

GENERAL PROVISIONS

  1. These Terms of Use do not anticipate any of the public, non-profit, academic, or international government Members providing funding to support the activities outlined in this agreement. Should member funding of any kind by these organizations, including registration or membership fees, be deemed necessary to support NISC activities, a separate agreement will be developed and presented for review and approval to NISC Members at large or to specific affected Members on a case by case basis in accordance with the NISC By-Laws, as they may be amended over time.
  2. Anything shared through these Terms of Use shall not be shared with anyone that is not a Member of the NISC without specific written permission from the originating Member. Notwithstanding the previous statement, disclosure of items related to this agreement shall be permitted consistent with the laws of the receiving Member’s jurisdiction and, specifically, those related to the provisions of any Freedom of Information Law or order of a court of competent jurisdiction.
  3. The Member accepting something from another Member shall do so at their own risk. The Originating Member shall not be held responsible for how the information or item is used after it is shared.
  4. Any Member can terminate their membership in the NISC through written notice to the NISC. Termination of membership will be effective upon receipt of written notifications.
  5. Any termination of membership shall not prejudice any rights or obligations accrued to the Members prior to termination.
  6. The NISC reserves the right to change these Terms of Use at any time and will notify Members of any such modifications.

USE OF ONLINE MEMBER PORTAL, NISC NEXUS

  1. Information may not be shared on this site that violates any copyrights, patents, or trademarks, or that is confidential in nature.
  2. Communication via this site may not be unlawful, offensive, threatening, obscene, or otherwise objectionable, including any communications that encourage criminal offenses or civil liabilities.
  3. No malware or harmful computer code may be uploaded.
  4. Personal information of other site users/NISC members may not be used or shared for marketing purposes.
  5. The operators of the site reserve the right to monitor any information shared via the site and to edit or remove content that is posted in violation of these terms of use.
  6. This site may contain links to external sites not owned or operated by the NISC. These links are provided for the convenience of site users and are not controlled by the NISC or the site operators. Content on these sites is not validated or endorsed by the NISC.
  7. Any actions taken by users of the site may not violate any applicable local, state, national, or international law.
  8. You agree to defend, indemnify and hold harmless the NISC and the site operators from and against any and all claims, damages, costs and expenses, including reasonable attorneys’ fees, arising from or related to your use or misuse of this site.

*These Terms of Use replace the Memorandum of Agreement (MOA) as the document governing the rights and responsibilities of the NISC and of members. Fully executed copies of the previous versions of the NISC MOA are on file. Those entities that signed the previous versions of the NISC MOA will be grandfathered into these Terms of Use.
